2. Acceptance of These Terms

By accessing this website, booking a discovery call, signing a coaching agreement, signing a consulting agreement, or engaging with Sara's services in any way, you agree to be bound by these Terms of Service. These terms apply to all visitors to the website and all clients who engage coaching services.

3. Use of This Website

You are welcome to browse, read, and share content from this website for personal, non-commercial purposes. You agree not to use this website in any way that is unlawful, harmful, or fraudulent; infringes intellectual property rights; transmits unsolicited commercial communications; or interferes with the proper functioning of the website.

4. Coaching Services

Coaching is a collaborative, forward-focused partnership aimed at supporting personal and professional growth. It is not a substitute for therapy, counselling, psychiatry, psychology, or any other form of licensed mental health treatment or medical care. Sara is a coach, not a licensed therapist, psychologist, or medical professional. Clients take full responsibility for their experience. Clients are encouraged to seek licensed professionals for such matters.

Exceptions to Confidentiality

Sara is legally obligated to disclose information where there is a credible risk of harm to the client or to another person; where disclosure is required by a valid court order or applicable law; or where the client provides explicit written consent to disclosure.

Client Responsibilities

· Attending sessions at the agreed time or providing adequate notice of cancellation

· Taking responsibility for their own decisions and actions throughout the engagement

· Notifying Sara promptly if their circumstances change in a way that affects the coaching relationship

Technology Requirements

All virtual coaching and consulting sessions are conducted via Zoom. Clients are responsible for ensuring they have access to a working device (computer, tablet, or smartphone) with:

· A stable internet connection

· Audio and video capabilities

· The Zoom platform installed and functioning properly

· You are responsible for ensuring you have the appropriate device, software, or application needed to open and use the files. Blossoming Beyond the Binary is not responsible for compatibility issues related to your device, browser, or software.

5. Payment and Refunds

Free Consultation Eligibility

A complimentary virtual consultation is available only to first-time clients of Blossoming Beyond the Binary LLC. The complimentary session is intended to help new clients assess fit, clarify goals, and understand the coaching and consulting approach before committing to paid services.

Returning clients or individuals who have previously received a free consultation are not eligible for additional complimentary sessions. We reserve the right to decline requests that do not meet these criteria.

Coaching fees are set out in the individual coaching agreement. All fees are stated in US dollars. Payment is due as specified in the coaching agreement via Electronic Funds Transfer (EFT).

Cancellation and Rescheduling

· Cancellations or reschedules made at least 48 hours before the session: no charge

· Cancellations or reschedules made with less than 24 hours’ notice: the session fee may be charged in full at Sara's discretion

· No-shows without prior notice: the full session fee will be charged

Refunds

· Sessions already held are non-refundable

· Sessions paid for but not yet held will be refunded in full with at least seven days’ written notice

· If Sara ends the engagement for reasons unrelated to client conduct, a full pro-rata refund will be provided

Payments and Packages

· Payment for all coaching and consulting services is due before the delivery of any session unless otherwise agreed in writing.

· Coaching packages are available and must be used within the timeframe specified at the time of purchase. All package payments are collected upfront and are required before scheduling any included sessions.

· Coaching subscriptions are also available. By enrolling in a subscription, the client authorizes their selected payment method to be securely stored and charged automatically for recurring payments based on the agreed‑upon subscription term. Subscription payments renew according to the billing cycle selected at purchase and continue until the end of the subscription term purchased by the client.

All Sales Final

Due to the instant and irrevocable nature of digital delivery, all digital product sales are final. By completing your purchase, you acknowledge that you receive immediate access to the content and waive the right to request a refund.

6. Intellectual Property

All content on this website is the intellectual property of Blossoming Beyond the Binary and is protected by applicable US copyright law. Clients who receive materials are granted a personal, non-transferable license for private use only. Anything a client creates or shares within the coaching relationship remains the intellectual property of the client.

Blossoming Beyond the Binary offers digital products that are delivered electronically. By purchasing any digital product, you agree to the following terms:

Digital Delivery

All digital products are delivered electronically via download link or email. No physical items are shipped. Access is provided immediately upon purchase.

License & Permitted Use

Purchasing a digital product grants you a non‑exclusive, non‑transferable, single‑user license for personal use.

You may not:

Share, resell, or redistribute the files
Upload the content to public websites or shared drives
Use the content to create derivative or competing products

All digital materials remain the intellectual property of Blossoming Beyond the Binary.

Prohibited Uses

To protect the integrity of our work, the following actions are strictly prohibited:

Copying or distributing the product beyond your personal use
Claiming the content as your own
Using the product for commercial purposes without written permission

Technical Requirements

You are responsible for ensuring you have the appropriate device, software, or application needed to open and use the files. Blossoming Beyond the Binary is not responsible for compatibility issues related to your device, browser, or software.

Access Support

If you experience issues accessing your files Blossoming Beyond the Binary will assist with re‑delivery or troubleshooting. Support does not include refunds for digital products.

All Sales Final

7. Limitation of Liability and Disclaimers

Sara does not guarantee any specific outcome from participation in coaching services. Nothing in the coaching relationship should be understood as therapy, diagnosis, treatment, or mental health advice. If you are experiencing a mental health crisis, please contact a licensed mental health professional or emergency services.

While we strive to provide high-quality coaching and consulting services, Blossoming Beyond the Binary makes no representations or guarantees regarding specific outcomes, results, or improvements.

Client success is influenced by a variety of factors beyond our control, including individual effort, engagement, decision-making, market conditions, and external circumstances. Any testimonials, case studies, or examples shared are illustrative only and do not constitute a promise or prediction of future performance.

By engaging our services, the client acknowledges and agrees that coaching and consulting are inherently subjective processes, and that results may vary. Blossoming Beyond the Binary shall not be held liable for any perceived lack of progress, unmet expectations, or decisions made by the client based on the services provided.

No verbal or written communication shall be construed as a guarantee of specific outcomes unless expressly stated in a signed agreement.

8. Privacy and Data

Sara collects only the information necessary to operate her coaching practice, including name, email, contact details, booking information, and information shared through intake forms and sessions. Your data is used only to manage the coaching relationship, schedule sessions, maintain records, and send service-related communications.

Sara does not sell, rent, or trade personal information to any third party. Sara uses third-party tools including Google Workspace, Acuity for scheduling, Squarespace for her website and Zoom for coaching sessions.

9. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the State of Florida, United States. Any legal action shall be brought exclusively in the state or federal courts located in St. Johns County, Florida. Sara's preference is always to resolve any dispute through direct, honest conversation first.

10. Changes to These Terms

Sara reserves the right to update these Terms of Service at any time. Continued use of the website or coaching services after changes are published constitutes acceptance of the revised terms.
